Justera, operated by CLARK MEDIA, is committed to transparency about how we use artificial intelligence and automated decision-support systems. This notice explains how these systems work, what data they use, and your rights under the EU AI Act and GDPR Article 22.

Justera uses automated decision-support systems to assist transport operators with dispute management, legal compliance, and risk assessment across European jurisdictions.

Key Principles

  • Advisory only: Our automated systems provide recommendations and draft documents. They never make legally binding decisions on your behalf.
  • Human in the loop: All critical decisions require human review and approval before any action is taken.
  • Transparency: You are always informed when an output has been generated or influenced by automated systems.

2. How Automated Systems Are Used

Our platform employs automated systems in the following areas:

Dispute Analysis

Determines the applicable law for each case, assesses the strength of evidence, and estimates the probability of a successful outcome.

Document Generation

Creates draft legal documents (pre-court notices, settlement letters, lawsuit filings) based on case data and the applicable legal framework.

Case Matching

Identifies similar past cases from anonymised historical data to provide relevant context and precedent for current disputes.

Mediation Support

Suggests settlement ranges and negotiation strategies based on applicable legal rules, case strength, and historical outcomes.

Compliance Monitoring

Checks transport operations against cabotage rules, driver hour regulations, load restrictions, and other country-specific requirements.

Risk Assessment

Evaluates risk levels per shipment, route, and counterparty based on historical data, compliance status, and dispute patterns.

3. Data Used by Automated Systems

Our automated systems process the following categories of data to generate recommendations:

  • Case details: Information you provide when reporting a dispute, including shipment data, dates, amounts, and descriptions.
  • Uploaded documents: CMR documents, invoices, contracts, delivery confirmations, and photos that you attach to cases.
  • Legal knowledge base: A curated database of European transport laws, EU regulations, CMR Convention rules, and relevant court precedents.
  • Aggregated outcomes: Anonymised and aggregated data from resolved cases used to improve prediction accuracy.

Data Isolation Guarantee

Automated systems never access personal data from other user accounts. Your case data is processed in isolation. Only fully anonymised and aggregated statistics are used for model improvement.

4. Human Oversight

We maintain strict human oversight over all automated processes:

  • Document review: All AI-generated documents are presented as drafts. You must review, edit if necessary, and explicitly confirm before any document is finalised or sent.
  • Supervisor approval: High-risk outputs, including lawsuit documentation and legal escalations, require approval from a designated supervisor or legal reviewer within your organisation.
  • Override capability: You can override, modify, or reject any automated recommendation at any point in the workflow.
  • Escalation to human experts: Complex or ambiguous cases can be escalated to human legal professionals through our platform's legal collaboration features.

5. Your Rights Regarding Automated Decisions

Under GDPR Article 22 and the EU AI Act, you have the following rights in relation to automated decision-making:

Right to Explanation

You can request a clear explanation of how any automated recommendation was reached, including the data and logic used.

Right to Human Review

You can request that any automated output be reviewed by a qualified human before it is acted upon.

Right to Contest

You can contest any automated decision or recommendation and request reconsideration through alternative means.

Right to Opt Out

You can opt out of specific automated features while continuing to use the platform's core functionality.

  • Not legal advice: Automated outputs are decision-support tools and are not a substitute for professional legal advice from a qualified attorney.
  • Edge cases: The system may not adequately cover highly unusual or novel legal scenarios that fall outside established precedent.
  • Input quality: The accuracy of recommendations depends directly on the completeness and accuracy of the data you provide.
  • Legal changes: While we continuously update our legal knowledge base, there may be a brief delay between new legislation taking effect and its incorporation into our system.

7. EU AI Act Compliance

Justera is designed and operated in compliance with the European Union Artificial Intelligence Act (EU AI Act):

  • Risk classification: Our system is classified as limited-risk. It functions as a decision-support tool and does not make autonomous binding decisions.
  • Transparency obligations: This notice fulfils our obligation to inform users that they are interacting with AI-powered systems and to explain how those systems function.
  • Human oversight: We maintain meaningful human oversight at every stage where automated systems generate outputs that may affect legal or financial outcomes.
  • Regular assessments: We conduct periodic accuracy assessments, bias audits, and performance evaluations of our automated systems.

8. Continuous Improvement

Our automated systems are designed to improve over time while maintaining strict data protection standards:

  • Outcome-based learning: The system learns from the outcomes of resolved disputes using fully anonymised and aggregated data. No individual case data is used for model training without anonymisation.
  • Legal knowledge updates: Our legal knowledge base is regularly updated with new legislation, regulatory changes, and relevant court rulings from all supported European jurisdictions.
  • Administrative oversight: All learning processes and model updates are supervised by qualified personnel to ensure accuracy, fairness, and compliance.
