These Terms for Lawyers govern the participation of independent legal professionals in the Justera lawyer marketplace operated by CLARK MEDIA. By registering as a lawyer on Justera, you agree to these Terms in addition to the general Terms of Service.
1. Eligibility
You must hold a valid, active bar admission or equivalent professional legal qualification in at least one EU or EEA member state.
You must hold professional indemnity (liability) insurance covering transport law and dispute management services at a minimum value of EUR 100,000 per claim.
You must not be subject to any ongoing disciplinary proceedings, suspension, or disbarment by your bar association or regulatory body.
Only individuals may register as lawyers. Law firms must register each lawyer individually.
Specialists in transport law, CMR Convention, cross-border logistics disputes, or EU freight regulation are preferred but not exclusively required.
2. Registration and Verification
Verification Required
All lawyer registrations are subject to manual verification by CLARK MEDIA before the profile is made visible to clients.
You must submit the following during registration: valid bar membership certificate or equivalent, proof of professional indemnity insurance, government-issued ID or passport, contact details and operating jurisdiction(s).
CLARK MEDIA reserves the right to request additional documentation to verify your professional credentials.
Verification typically takes 3–5 business days. You will be notified by email of the outcome.
Providing false or misleading information during registration will result in immediate account termination and may be reported to your bar association.
Your profile must accurately reflect your areas of specialisation, jurisdictions covered, languages, and availability.
3. Lawyer Profile and Availability
Your profile is visible to Justera clients who have submitted relevant transport disputes in your jurisdiction(s) of practice.
You are responsible for keeping your profile accurate and up-to-date, including your areas of expertise, pricing, and availability.
You may indicate your availability status (available, limited, unavailable) to control the volume of case proposals you receive.
CLARK MEDIA reserves the right to temporarily deactivate profiles with response rates below 20% over a 30-day period.
You may include a short professional biography, practice areas, and representative case types. Testimonials or endorsements must be genuine and verifiable.
4. Case Assignment and Acceptance
When a client selects you for a case, you will receive a case proposal via email and platform notification.
You have 48 hours to accept or decline a case proposal. If no response is received within 48 hours, the proposal is automatically withdrawn.
Before accepting, you must review the case summary and confirm there is no conflict of interest.
Upon acceptance, you will have access to the full case file including dispute details, uploaded documents, and AI-generated analysis.
You may decline any case proposal without providing a reason. Repeated unexplained declines may affect your profile ranking.
5. Service Standards
Professional Obligations
By participating in the Justera marketplace, you commit to maintaining the highest standards of professional conduct as required by your bar association and applicable law.
You must respond to client messages within 2 business days of receipt.
You must provide legally accurate, jurisdiction-appropriate advice and document review.
All documents prepared for clients must comply with the applicable national law and procedural rules of the relevant jurisdiction.
You must disclose any conflict of interest before or immediately upon becoming aware of it.
You must maintain client confidentiality in accordance with your professional obligations and GDPR.
You may not subcontract case work to third parties without the client's explicit prior consent.
6. Fees and Commission
You set your own fees for legal services, which are displayed on your Justera profile.
CLARK MEDIA charges a platform commission of 15% of the total fee agreed with the client for each case successfully closed through the platform.
Payments from clients are processed via the platform. CLARK MEDIA remits your fee (minus commission) within 14 business days of case completion and confirmed payment.
Fees must be quoted in EUR or PLN. For Polish clients, prices may be displayed in PLN; for all other EU clients, EUR.
You are solely responsible for invoicing clients, calculating and paying any applicable taxes (VAT, PIT/CIT) on your earnings, and complying with your national tax obligations.
CLARK MEDIA will provide a commission statement at the end of each calendar month.
7. Intellectual Property and Documents
Legal documents you prepare for clients belong to the client. You retain no ownership over work product delivered through the platform.
You may use AI-generated draft documents provided by the Justera platform as a starting point for your work, but you are solely responsible for reviewing, verifying, and finalising all documents before delivery to the client.
You must not use Justera client data, case details, or platform-generated content for any purpose other than serving the specific case for which it was provided.
You may not copy, redistribute, or commercialise templates, AI outputs, or legal knowledge base content from the Justera platform.
8. Confidentiality
You must keep all client information, case details, and dispute data strictly confidential.
Confidentiality obligations survive termination of your participation in the Justera marketplace indefinitely.
You must implement appropriate security measures to protect client data accessed through the platform.
Any suspected breach of client data must be reported to CLARK MEDIA at legal@justera.eu within 24 hours of discovery.
9. Liability
You are solely and fully liable for the legal advice, document review, and other legal services you provide to clients through the platform.
CLARK MEDIA is not a law firm, does not supervise your legal work, and assumes no liability for the quality, accuracy, or outcomes of legal services you provide.
You agree to indemnify and hold CLARK MEDIA harmless against any claims, losses, or damages arising from your provision of legal services through the platform.
CLARK MEDIA's liability to you is limited to fees paid to CLARK MEDIA by you in the 12 months preceding any claim.
10. Ratings and Reviews
Clients may rate and review your services after case completion. Ratings are displayed on your profile.
You may not solicit, incentivise, or manipulate client reviews. Any attempt to do so will result in account termination.
You may respond professionally to reviews through the platform's response feature.
CLARK MEDIA reserves the right to remove reviews that violate platform policies (e.g., defamatory, false, or offensive content).
11. Termination
You may deactivate your lawyer profile at any time through your account settings. Active cases must be completed or transferred before deactivation.
CLARK MEDIA may suspend or terminate your profile for: providing false credentials, violations of professional conduct standards, repeated poor client feedback, breach of these Terms, or legal or regulatory reasons.
Upon termination, your profile is removed from the marketplace. Ongoing cases will be reassigned to other lawyers with client consent.
Outstanding fees owed to you at the time of termination will be paid within 30 days, subject to any pending disputes.
12. Governing Law
These Terms are governed by Polish law for lawyers registered in Poland.
For lawyers registered in other EU member states, applicable consumer and professional protection regulations of their home country may also apply.
Disputes arising from these Terms shall be subject to the jurisdiction of the courts in Toruń, Poland, unless mandatory provisions of your home country's law provide otherwise.
